Recipes By Mums respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the Recipes By Mums website (recipesbymums.com).
If you believe that content available on or through our website infringes your copyrights, please follow the procedures outlined below.
How to File a DMCA Takedown Notice
To file a DMCA takedown notice, please send a written notification to our designated DMCA Agent containing the following information:
- Identification of copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
- URL of infringing content: Identification of the material that is claimed to be infringing and information reasonably sufficient to permit Recipes By Mums to locate the material (e.g., the specific URL of the page).
- Contact information: Your name, address, telephone number, and email address so we can contact you regarding your complaint.
- Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Counter-Notification Procedure
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the right to post and use the content, you may file a counter-notification containing the following information:
- Your physical or electronic signature.
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Recipes By Mums may be found).
- A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
If a valid counter-notification is received, Recipes By Mums may restore the removed content within 10-14 business days, unless the copyright owner files a court action against the content provider.
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Recipes By Mums has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. Recipes By Mums may also, at its sole discretion, limit access to the website and/or terminate the access of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
